Terms of service

Terms governing the web hosting services of New Mind s.r.o. and the personal data processing policy. This document takes effect on the date of publication.

1. Introductory provisions

These terms govern the relationship between the provider, New Mind s.r.o., registered office at Bělehradská 858/23, Vinohrady, 120 00 Prague 2, Company ID 03579409, VAT ID CZ03579409, registered in the Commercial Register (Municipal Court in Prague, section C, file 233858) – the "provider" – and the customer ordering web hosting (New Mind Web Hosting) and related services, namely domain registration and administration, mailboxes, DNS hosting, SSL certificates, backups and website transfer from another provider (the "customer"). By ordering a service the customer confirms they have read and agree to these terms.

2. Orders and conclusion of contract

A contract is concluded by submitting an order through the order form on the provider's website and its confirmation by the provider. In the order the customer selects a prepaid term – 1, 12 or 36 months – and states the domain the site will run on. Once the proforma invoice is paid, the provider sets up the hosting account, usually within minutes of the payment arriving, and sends the access credentials to the e-mail address given in the order. The customer is responsible for the accuracy of the billing and contact details and must report any change without undue delay or make it in the client area.

3. Prices and payment terms

The prices listed on the provider's website are final, that is including VAT at the statutory rate of 21%. The provider is a VAT payer, VAT ID CZ03579409. The customer pays in advance for the selected prepaid term (1, 12 or 36 months) on the basis of a proforma invoice; upon receipt of payment the provider issues a tax document, available in the client area. The service is active for the whole prepaid term and the price of the selected term does not change during that term.

No setup fee is charged. Within 30 days of the service being set up the customer is entitled to a refund of the amount paid, with no reason required; a request sent to the provider's contact e-mail is sufficient. With the 12 and 36 month terms a .cz domain for the first year is included in the price. Website transfer from another provider is always free, regardless of the term selected.

4. Operation and availability

The provider operates the web hosting in a TIER III datacenter in Prague and guarantees availability at an SLA of 99,9 %. Availability is monitored continuously. The service includes daily backups kept for 30 days, network-level DDoS protection and a Let's Encrypt certificate with automatic renewal. The provider may carry out necessary maintenance and security updates of the servers; planned outages are announced in advance by e-mail and are normally scheduled for low-traffic periods.

5. Rights and obligations

The customer undertakes to use the service in accordance with the applicable law of the Czech Republic. It is prohibited to host content contrary to Czech law, content infringing the rights of third parties and software intended for attacks on other systems. The provider offers technical support by e-mail and phone on a 24/7 basis, in Czech and English.

Web hosting is a shared service, so fair-use rules apply. The unlimited parameters of the plan – the number of sites, domains, subdomains, mailboxes, databases and the volume of data transferred – are intended for the normal operation of websites and e-shops. In particular, it is prohibited to send unsolicited commercial messages (spam) from the provider's servers and to use the disk space as backup or data storage unrelated to running a website, for example storing archives, films, music or backups of other systems. The provider may throttle processes that place an excessive load on the shared server at the expense of other customers; the customer is notified in advance and offered a solution.

The customer is responsible for the content they publish on the hosting and for the processing of personal data within their own application. The customer is also responsible for updating their application, its extensions and templates; an outdated content management system is the most common cause of a compromised website. The provider maintains an up-to-date server platform and may temporarily suspend a site that has demonstrably been compromised and endangers other customers or mail recipients; the customer is informed immediately and given assistance with remediation, including restoring from a backup.

6. Term and termination

The service is arranged for the selected prepaid term and, once it expires, automatically renews for a term of the same length. The provider sends an e-mail notice of the upcoming renewal in advance together with a proforma invoice. The customer can switch automatic renewal off at any time in the client area; the service then ends when the paid term expires. Either party may terminate the service at the end of the prepaid term.

After the service ends the provider keeps the customer's data for 30 days so that it can be exported or the service restored; after that period the data and backups are irreversibly deleted. Beyond the statutory rights, the provider refunds the payment within 30 days of the service being set up with no reason required (see article 3). A consumer has the right to withdraw from the contract within the statutory period under the Civil Code. Domains registered in the customer's name remain theirs and can be transferred to another provider.

7. Personal data protection (GDPR)

The provider processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll. The data controller is New Mind s.r.o.. We process identification, billing and contact data and data necessary for operating the service – for the purpose of concluding and performing the contract and meeting legal obligations. With regard to the data the customer stores on the hosting, the provider acts as a processor and handles it only to the extent necessary to run and support the service. We do not share data with third parties except where required by law.

The customer's data, including websites, databases, mailboxes and backups, stays at all times on servers in a datacenter in the Czech Republic (Praha, ČR (TIER III)) and is not transferred outside the European Union. 8. Final provisions

Matters not governed by these terms are subject to the law of the Czech Republic. The provider reserves the right to update these terms; customers are informed of any material change by e-mail at least 30 days in advance and may in that case terminate the service as of the effective date of the change.
